TERMS AND CONDITIONS and Cancellation/Refund Terms.

 

 

Section 1 : Our customers are expected to read and agree with these Terms & Conditions, FAQ and Privacy policy before availing our services.

Section 2 : All our Service Packages will be activated instantly and will be valid for 1 year from the date and time of activation.

Section 3 : Services eligible to avail under the Service Packages are for the subscribed vehicle only and not for an individual.

Section 4 : Our service is available only within the service area defined below under section-23.

Section 5 : Please read completely the information available under Breakdown support at full length before availing the breakdown services.

Section 6 : Please read completely the information available under Services & Repairs at full length  before availing the Regular services & repairs.

Section 7 : Please read completely the information available under Towing Services at full length before availing the Towing service.

Section 8 : Please read completely the information available under Service Packages at full length before buying our service packages.

Section 9 : In case if a customer calls us for any services for of the vehicle which is not subscribed under Surummanda Solutions Private Limited will follow the one-time request and price. For details please refer to Section: 5,6,7 & 8.

Section 10 : Towing under the package is applicable only if the vehicle is immobilized and will be towed only to the Surummanda Solutions Private Limited support center. In case if the customer wants the vehicle to be towed to their preferred location then the towing cost will need to have to be beard by the customer as per the rates mentioned in Towing Services.

Section 11 : Customer under packages will still be charged in case of cranes used to recover a vehicle from accident spots.

Section 12 : In case of emergency fuel delivery, it is mandate mandatory for the customer to provide a copy of a government ID proof.

Section 13 : Surummanda Solutions Private Limited will strive and ensure to provide services within the stipulated time, however Surummanda Solutions Private Limited is not responsible for any delay caused by conditions beyond the control of company like traffic jams, riots, road blocks, route diversions, rain, flood, any natural calamities, Failure of service providers, rallies, state bandh etc., or which comes under force majeure.

Section 14 : In case of misuse of our services, non-payment of services charges, misbehaving from e to the service providers or any kind of activity which is beyond the terms and conditions of this agreement or breach any clause of the agreement or any activity which is punishable under the eyes of law – The company reserves all the rights bar a customer subscription with an email notification.

Section 15 : Surummanda Solutions Private Limited is not responsible for incorrect or incomplete information provided by the customer while subscribing for our packages and the consequences caused thereafter.

Section 16 : Surummanda Solutions Private Limited is authorized to add, alter or amend or change any or all the terms and conditions at its own discretion at any time without prior intimation. So, we would request our customers to periodically visit our Terms & Conditions and other relevant contents.

Section 17 : Surummanda Solutions Private Limited is not liable for any claims/refunds whatsoever after 3 days of service completion. No refund / cancellation of service packages is accepted without availing any service as part of the package. Surummanda Solutions Private Limited will arrange an alternate technician if the customer is unhappy or unsatisfied with the services availed. If the customer decides to go further with a technician of their preference, then Surummanda Solutions Private Limited would consider only of refunding the Labour cost charged. However, the cost involved in spares replacement cannot be refunded. We will refund only 60% of the total amount if the customer decides to cancel any of our packages after availing one services. We will refund only 25% of the total cost if the customer decides to cancel our package after availing more than one services. No refund will be applicable if the customer cancels our package after availing 3 or more services  or after 90 days of package subscription. The refund is subject to investigation and proved to have a quality remark with the service provided. All the approved refunds will be processed within 15 bank working days from the date of approval.

Section 18 : In case of 5 consecutive breakdown/towing service request of same service for a same vehicle under the package will call for an investigation to research on the situation to recommend the best possible fix for the issue. The customer will be charged for a service, if in case the customer submits the same service request again without fulfilling the recommended fix by Surummanda Solutions Private Limited.

Section 19 : Surummanda Solutions Private Limited is not liable for any mishandling damages caused by the Service Engineer while providing the service.

Section 20 : Customers are requested to ask for the original bills in case of spares replacement and also the replaced old spares. Please write to info@soskru.com in case if the bills and spares are not provided.

Section 21 : Surummanda Solutions Private Limited has taken all measures to provide a safe and secure services to our stranded customers. We have Surummanda Solutions Private Limited field force on request to support female customers during incidents at night hours times. However, we would request every customer to be aware and conscious about self-security and report to the nearest police station or nearest secure location in case of threat. Surummanda Solutions Private Limited is not legally or in any way liable for any safety and security concerns in any case whatsoever.

Section 22 : For commercial vehicles – Surummanda Solutions Private Limited service package is applicable only under the availability of a valid fitness certificate of the vehicle (FC).

Section 24 : Surummanda Solutions Private Limited services under the packages are not available for immobilization resulting from damages caused by intervention of police or other authorities, Vehicles kept in a non-roadworthy condition or not serviced in accordance with the manufacturer’s recommendations.

Section 25 : Surummanda Solutions Private Limited services under the packages are not applicable under an event where the driver of the vehicle is found to be in any of the situations listed – under the influence of alcohol, drugs, toxins or narcotics not medically prescribed, under the age of 18 years, without a valid driving license, participation in a criminal or offence act, exceeding the limit of number of passengers + driver permitted to travel, carrying over weight load than the permitted weight or in any condition punishable as offence under the eyes of law..

Section 26 : Surummanda Solutions Private Limited will take in-charge of situations during medical emergency where the customer is fully or partially in unconscious stage. Surummanda Solutions Private Limited team will take care of all the expenses made until we handover the customer to a concerned authority like family member or friend or any other concerned person. The expenses incurred till the delivery of the concerned customer that point needs to be reimbursed to Surummanda Solutions Private Limited by the concerned authority while taking in-charge of the customer. Surummanda Solutions Private Limited will relay the message to the concerned authority only in case if the customer has updated his/her emergency contact. There are situation Surummanda Solutions Private Limited can fail to provide this service on-time due to conditions those are listed in section-10

Section 27 : Surummanda Solutions Private Limited will provide unlimited assistance during lock-out situations. The assistance includes arrangement of a skilled professional to handle the issue and help the customer let inside the vehicle. The service charge is taken care by Surummanda Solutions Private Limited, however the customer needs to bear the labour cost and spare cost. It is mandatory to share the ID copy with the Surummanda Solutions Private Limited service engineer. Once the issues are solved then the vehicle ownership will be validated against the ID proof. In case if the driver ID and the vehicle ownership differs, then by accepting this term, customer is agreed to seize the car by Surummanda Solutions Private Limited for safety reasons.

Section 28 : Surummanda Solutions Private Limited legal support is subject to the availability of lawyers and police officials at the time of incident. Our service is limited to notifying the respective police station or police official judiciary and provide a lawyer on call for consultation. Lawyer consultation fee is applicable and varies from case to case. In case, if a customer wants to continue with litigation through our lawyers then it is between the customer and the lawyer to discuss and decide on further actions. Charges are applicable as per lawyer’s terms and conditions.

Section 29 : Authorization to contact – By agreeing this terms, a customer availing our services through application request or website request or through any other means is authorizing Surummanda Solutions Private Limited to use their contact information like Phone number, email ID & address for further communication by SMS or Calls or emails.

  • We are expecting our customers to readand agree our T&C carefully before availing our services.
  • The following services will be offered with certain conditions:

 

    • Emergency fuel delivery: Fuel will be filled into the vehicle fuel tank directly by our technicians and there will be no physical delivery either on bottle or any kind of utensils. Incases where the fuel cannot be filled to the vehicle by our technicians, then the order stands cancelled. In such cases, the customer has to pay the standard service charges as applicable.

 

    • Locked Vehicle: Our highly skilled professionals will deal with this issue to make your vehicle damage free. Customer needs to bear the service charges as well ascost of spare parts. The services will be available to the direct owner of the vehicle. In case, the vehicle is in possession of some other person, then the owner of vehicle have to provide his personal Government ID Proof on digitally to satisfy our professional. Incase, the customer ID and the vehicle ownership are different, then in that case the garrageonsite may call the local Police or may seize the vehicle for safety reasons. In any case, the customer has to pay the standard service charges as applicable.

 

    • Lost Key: Our technicians will resolve your query. Customer needs to bear the service charges as well ascost of spare parts. The services will be available to the direct owner of the vehicle. In case, the vehicle is in possession of some other person, then the owner of vehicle have to provide his personal Government ID Proof on digitally to satisfy our professional. Incase, the customer ID and the vehicle ownership are different, then in that case the Surummanda solutions pvt ltd may call the local Police or may seize the vehicle for safety reasons. In any case, the customer has to pay the standard service charges as applicable.

  • We will strive and ensure to provide services within the stipulated time.However,garage onsite is not responsible for any delay beyond the control of company like traffic jams, riots, road blocks, route diversions, rain, flood, any natural calamities, Failure of partner service providers, rallies, state bandh etc.

 

  • In case of misuse of our services, non-payment of services charges, misbehaving to our technicians/employees – The company reserves all the rights to bar a customer’s subscription/profile/service and take necessary legal action against customer.

 

  • Weare not responsible for any incorrect information provided by our customers while booking a service/package/subscription and the consequences caused thereafter.

 

  • We are authorized to add or change any or all the terms and conditions at its own discretion at any time without prior intimation.

 

  • We are not liable for any claims/refunds whatsoever after 3 days of service completion. No refund/cancellation of service packages are accepted without availing any services as part of the package. An alternate technician can be arranged if the customer is unhappy with the service availed. If the customer decide to go further with a technician of their own preference other than garage onsite, in that case we would consider to refund the service charge/Labour charges. However, the cost involved in spares replaced cannot be refunded. Incase of packages, we will refund 60% of the subscription price charged to the customer while buying the subscription, if the customer decide to cancel any of our subscriptions or packages after availing one service. We will refund 25% of the subscription price charged to the customer while buying the subscription, if the customer decides to cancel our package after availing more than one service. No refund is applicable if the customer cancels our package after availing 3 services or after 90 days of package or subscription. The refund is subject to investigation and proved to have a quality issue with the service provided. All the approved refunds will be processed within 15 bank working days from the date of approval.

 

  • We are not liable for any mishandling and damages caused by the technicians while providing the service.

 

  • Customers are requested to ask for the old spares replaced. Bills will be send via email to the registered email ID. Please write to info@soskru.com incase if the bills for replaced spares are not provided.

 

  • Services eligible to avail under the subscription or Packages are for the respective vehicle registered for the particular package or subscription and not for any individual person.

 

  • Customer under subscription or packages will be charged incase of cranes used to recover a vehicle from accident spots.
  • Incase of 3 consecutive request of same service for a same vehicle under the subscription or package will call for an investigation to research on the situation to recommend the best possible fix for the issue. The customer will be charged for a service, if incase the customer submits the same service request again without fulfilling the recommended fix by garage onsite.
  • Surummanda Solutions Pvt Ltd or SOS Kru has taken all measures to provide a safe and secure service to our valuable customers. We would request every customer to be aware and conscious about self-security and report to the nearest police station or nearest secure location or garage onsite incase of threat. Surummanda Solutions Pvt Ltd or SOS Kru is not legally liable for any safety and security concerns.

 

  • Our services under the subscriptions or packages are not available for immobilization resulting from damages caused by intervention of police or other authorities.

 

  • Our services under the subscriptions or packages are not applicable under an event where the driver of the vehicle is found to be in any of the situations listed here – under the influence of alcohol, drugs, toxins or narcotics not medically prescribed, under the age of 18 years, without a valid driving license, involved in a criminal/illegal act, exceeding the limit of number of passengers + driver permitted to travel, carrying over weight load than the permitted weight.

 

  • Authorization to contact – By agreeing to this terms & conditions, a customer availing our service through app request or website or through any other medium is authorizing Surummanda Solutions Pvt Ltd or SOS Kru to use their contact information like Phone number, email ID & address for further communication by SMS or Calls or emails.

 

  • Points to be noted:

 

    • Government ID Proof is necessary to be shared with garage onsite before availing any of the above-mentioned services.
    • The charges will be subject to any special offer/special package, company is providing to their customers.
